Terms of sale

1. Scope

These terms apply to distance sales concluded through the website (form, email or WhatsApp) between the seller and a consumer: shop items and spare parts.

The sale of a car and workshop jobs are governed by specific terms: a signed order form or quote stating the car, the price, payment, delivery and warranty terms. These terms apply in addition.

3. Products

The main characteristics of the products are shown on the website or given before the order. Availability is confirmed in writing when ordering.

4. Prices

Prices are given in euros, all taxes included. Any delivery costs are stated before the order is confirmed. The applicable price is the one confirmed to the customer in writing.

5. Orders

The customer sends a request through the website form, by email or WhatsApp. The seller replies with a summary (product, price, costs, lead time). The order is binding once the customer accepts this summary and payment is received.

6. Payment

Payment is made by bank transfer or by any other means stated in the order summary. When online payment is offered, it is handled by a secure payment provider; the seller never has access to card details.

7. Delivery

Products are handed over at the Mougins workshop or shipped to the address given by the customer, within the lead time stated in the summary; failing that, no later than thirty days after the order (Article L216-1 of the French Consumer Code).

The risk of loss or damage passes to the customer when they take physical possession of the products (Article L216-4).

8. Right of withdrawal

Under Articles L221-18 et seq. of the French Consumer Code, consumers have fourteen days from receipt of the product to withdraw from the contract without giving any reason.

They notify their decision by an unambiguous statement (email or letter), for example using the model form below, and return the product no later than fourteen days after that notification, at their own cost. The seller refunds all sums paid, including the initial delivery costs, within fourteen days of the notification; the refund may be withheld until the product has been received back (Article L221-24).

The right of withdrawal does not apply to products made to the customer’s specifications or clearly personalised (Article L221-28), nor to contracts concluded on the seller’s premises, such as the sale of a car signed at the workshop.

9. Legal warranties

The seller is bound by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): the customer has two years from delivery to act and may choose between repair and replacement under Article L217-9, or obtain a price reduction or cancellation of the sale in the cases set out in Article L217-14. A defect appearing within twenty-four months of delivery, or twelve months for second-hand goods, is presumed to have existed at delivery (Article L217-7).

The seller is also bound by the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code): proceedings must be brought within two years of discovering the defect; the customer may choose between cancelling the sale and a price reduction (Article 1644).

10. Complaints and mediation

Complaints can be sent to originalclassic.mougins@gmail.com.

In the event of a dispute, after a written complaint that has not been satisfactorily answered, consumers may refer the matter free of charge to a consumer mediator (Articles L611-1 et seq. of the French Consumer Code).

11. Personal data

Customer data is processed in accordance with the website privacy policy.

12. Governing law

These terms are governed by French law. Consumers also benefit from the mandatory provisions of the law of their country of residence.
